These Terms of Use ("Terms") govern your access to and use of AI, Look! (the "Service"), a macOS desktop application operated by 477 Studio Pty Ltd ("we", "us", "our"). By using the Service, you agree to be bound by these Terms.

1. Eligibility & Registration

You must be at least 13 years old or meet the minimum age requirement in your jurisdiction to use the Service. If you are a minor, you need parental or guardian consent. If you are using the Service on behalf of an organisation, you warrant that you have authority to bind that organisation to these Terms. You must provide accurate information during registration and are responsible for maintaining the security of your account. You are liable for all activity under your account.

2. Provision of the Service & Licences

We grant you a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms. We retain ownership of all intellectual property in the Service, its software, and all related content, except for your data. We may modify, update, or discontinue the Service with reasonable notice.

3. Your Data & Local Processing

AI, Look! processes all screenshots and screen recordings locally on your device. No screen content — images, videos, or recordings — is transmitted to or stored on our servers. You retain full ownership of all content you capture. We may collect de-identified usage metadata (such as feature usage frequency) to improve the Service, but this never includes the content of your screenshots or recordings. You warrant that you have the necessary rights to any material you capture and share using the Service.

4. Acceptable Use

You agree not to use the Service:

• For any illegal, unlawful, or harmful purpose
• In a way that infringes third-party rights
• To capture or distribute content you do not have rights to

You are responsible for ensuring compliance with all applicable laws. We may suspend your access for breach of these Terms.

5. Fees, Billing & Cancellation

Subscription fees apply as described on the Service website. You may cancel your subscription at any time, and you will retain access through the end of your current billing cycle. Subscription fees are non-refundable unless otherwise stated. We will provide prior notice of any fee changes and give you the opportunity to cancel before the new fees take effect.

6. Termination & Suspension

You may stop using the Service at any time. We may suspend or terminate your access immediately and without notice for breach of these Terms, illegal conduct, or misuse. Termination does not relieve you of outstanding payment obligations. Sections that by their nature should survive termination will remain in effect.

7. Intellectual Property & Ownership

You own your data and any content you capture using the Service. We retain exclusive ownership of the Service, its software, branding, and all related content. You may not copy, modify, distribute, reverse-engineer, or create derivative works from the Service without our prior written authorisation.

8. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising from or related to the Service is limited to the total amount you have paid to us in the twelve (12)-month period immediately preceding the claim. We exclude all indirect, consequential, and punitive damages. Nothing in these Terms excludes or limits rights you may have under the Australian Consumer Law that cannot be excluded.

9. Indemnity

You agree to indemnify and hold us harmless against any claims, damages, or expenses arising from: your breach of these Terms, your use of the Service, infringement of any third-party rights, or violation of any applicable law — except where caused by our gross negligence or wilful misconduct.

10. Privacy & Data Protection

Our Privacy Policy governs how we handle your personal information and is incorporated by reference into these Terms.

11. Feedback

If you provide feedback or suggestions about the Service, you grant us a perpetual, irrevocable, royalty-free, worldwide licence to use that feedback for any purpose without compensation.

12. Changes to Terms

We may revise these Terms from time to time. Material changes will be communicated via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Severability & Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will continue in full force. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of New South Wales, Australia. Any disputes are subject to the non-exclusive jurisdiction of the courts of New South Wales.

15. Disclaimers

The Service is provided "as-is" and "as-available" without warranties of any kind. We do not guarantee uninterrupted or error-free operation. You accept full responsibility for how you use the content you capture with the Service.
